TERMS AND CONDITIONS FOR LUCKY DRAW PROGRAMME

1. Promotion Programme: “Explore Festive Wonderland – Collect Trendy Presents”

2. Programme period: from 15/12/2018 to the end of 15/01/2019.

3. Eligible customers of the Promotion Program:

● The programme is only open to customers who meet the following requirements: All customers must be Vietnamese or foreigners who are living and working in Vietnam aged 15 and above (calculated by birthday to the date of service use), having valid identification paper (ID card, citizen identification or valid passport), having purchased tickets and completed check-in at one of the locations of VinPearl Land, VinPearl Safari in Quang Nam, Khanh Hoa, Kien Giang during the program period.

● The program is not open to employees and immediate families of employees from Vinpearl JSC, and member companies of Vingroup JSC.

4. Prize structure


Please note:

● All prizes cannot be exchanged for cash.

● For 1st Prize: The value of the Vinfast Fadil is the announced price, including VAT, excluding registration fee, plate number registration fee and other types of fee related to circulation registration and product transportation.

● For 2nd Prize: The value of the Vsmart is the announced price, including VAT.

● For 3rd Prize: VinID gift card is used to top up Customer’s VinID account. The gift card value can be used to pay for services provided by Vingroup JSC.

● The customer has the responsibility to pay personal income tax, extraordinary income tax (if any) before collecting their prizes.

5. Details of the conditions of the Promotion Programme

Conditions and procedures the customer has to follow to be eligible for the Promotion

During the promotion period, customers who are eligible for the lucky draw should be those aged 15 and above who purchase an adult ticket(s) at one of the locations of Vinpearl Land, Vinpearl Safari in Quang Nam, Khanh Hoa, Kien Giang and meet all the criteria on the eligibility of the Programme. After purchasing the ticket, at the ticket inspection area, for each valid pass, the customer will receive one coupon with a ten-character code in XXXXXXXXXX This code is unique for each ticket which is issued randomly and has no duplicate.

After passing the gate, the customer will use a smartphone having QR code applications namely Zalo, Viber, Facebook, BarcodeViet, Barcode Scan, iCheck Scanner & Shopping… which has internet connection either via 3G, 4G or wifi to scan QR code on coupon. After scanning the information the lucky draw promotion programme will be shown on the screen. The customer then fills in their personal details including lucky draw code printed on the coupon, ID/citizen identification/passport number, phone number and personal email.

○ Please note: The lucky draw code printed on the coupon is valid for a one time entry only. Any questions or complaints regarding the coupon and lucky draw code will only be resolved during the time the customer uses the services provided on the property of Vinpearl Land and Vinpearl Safari. Any questions or complaints lodged after the customer has left the above mentioned areas are considered invalid. After receiving the coupon the customer needs to submit information for the lucky draw programme before 24 hours on the same day.

Time, method of issuing proof of prize winnings

The coupon with the lucky draw code is sent directly to the customer after the customer has passed the ticket inspection point in the amusement park areas.

Regulations on proof of winnings

Vinpearl JSC will randomly pick the code which is also the lucky draw code on the coupon provided to the customer.

The total number of proof of winnings: based on the total number of valid coupons released and entered with valid information during the programme period.

Valid coupons are those that are not damaged, faded, torn, erased and do not show any sign of mutilation of whichever method.

The customer is considered the winner of the prize if:

The customer has a valid coupon with the same lucky draw code as the winning code announced by Vinpearl JSC

ID/passport number matches with the information which has been submitted to the system of Vinpearl JSC

Valid messages/emails notifying of the prize winning from Vinpearl JSC. Phone number and email will be announced no later than 20/01/2019 on the official page of the programme with the following address: festivewonderland.vinpearlland.com/the-le

Message format: Congratulations on winning 1st/2nd/3rd prize of “Explore Festive Wonderland – Collect Trendy Presents”. You are invited to the prize ceremony on 25/01/2018 {time} at Vinpearl Land Nha Trang, Hon Tre Island, Nha Trang City. Contact 1900636699

Email format: Subject: CONGRATULATIONS ON WINNING 1ST/2ND/3RD PRIZE OF LUCKY DRAW PROGRAMME “ĐẾN XỨ SỞ DIỆU KỲ – ĐÓN LỘC QUÀ SÀNH ĐIỆU”. Email content will be prepared according to Vinpearl JSC’s criteria.

Time, venue and method of winner drawing

Time: 19/01/2019

Venue: Vinpearl Land Nha Trang, Đảo Hòn Tre, phường Vĩnh Nguyên, thành phố Nha Trang, Khánh Hòa.

Method of winner draw

The company will select winning customers using Vinpearl JSC’s automatic lucky draw software. The company will use all customers’ lucky draw codes to conduct the draw.

The lucky draw will be held with the witness of representatives of the state’s trading agency, representatives of Vinpearl JSC, representative of the customers participation the Promotion Programme

The draw result will be announced in the order of 3rd Prize, 2nd Prize, 1st Any lucky draw code that is already announced for a prize cannot be included in the draw for other prizes. The result of the lucky draw will be documented with verification of the witnesses

Winning customers are those that meet all the following criteria

The ten-character lucky draw code on the coupon is the same as the ten-character code announced for each prize.

Information of ID card/ citizen identification/ passport/ other proof of identity is the same as the information provided when signing up for the Promotion Programme via Vinpearl’s system (as specified in Part 1 Clause 5.1)

For the 2nd prize and 3rd prize, the lucky draw will be conducted based on the number of customers who are eligible participants of the Programme in each region.

For the 1st prize, the lucky draw will be conducted twice:

First time: The codes from each region are drawn. Ten lucky customers of each region will be selected for the second draw.

Second time: Ten customers/region x 3 regions = 30 customers will be drawn to select one winner for the 1st

Winner announcement

Vinpearl JSC will announce the winning customers within five days after the lucky draw via the following methods: phone, message via email according to the information provided by the customer and uploaded on the website www.vinpearl.com

Time, venue, procedure of prize collection

Winning customers who attend the lucky draw on 19/01/2019 will receive the prize on the spot.

If the winning customers do not attend the lucky draw within five days after the lucky draw date, Vinpearl JSC will notify customers via the following methods:

Phone, message to signed up phone number and email provided

Time and venue for prize collection: Vinperal Land Nha Trang, Hon Tre island, Vinh Nguyen district, Nha Trang city, Khanh Hoa province on 25/01/2019

To collect the prize, the winning customers are required to show the following documents:

A valid coupon with the same lucky draw code as the winning code announced by Vinpearl JSC.

ID/passport number matching the information which has been submitted to the system of Vinpearl JSC

Valid messages/emails notifying of the prize winning from Vinpearl JSC

In the event that customers cannot come to collect the prize on 25/01/2019 they must authorize another person to collect the prize. The authorized person is required to provide Vinpearl JSC with the following documents:

Authorization letter/ authorization contract verified by the state competent authority;

A valid coupon with the same lucky draw code as the winning code announced by Vinpearl JSC.

A copy of the ID card/ passport of the winning customer, with verification by competent authorities

Message/Email notifying prize winning forwarded from phone number/email receiving the message/email from Vinpearl JSC.

In the event that the customer cannot come to collect the prize on 25/01/2019 and cannot authorize anyone to collect the prize they may request to collect the prize via post. This can be done by sending a request via registered email to Vinpearl JSC which includes the address and details of the receiver (name, ID number, phone number)

When collecting the prize via post, the customer is required to show the same documents he/she would show if collecting on the spot.

All shipping expenses will be covered by Vinpearl JSC based on the logistics agency’s regulation (not applied to the 1st Prize)

For the 1st Prize: Vinpearl JSC will directly contact the winning customer to present the prize in Ha Noi, Ho Chi Minh City or the address provided by the customer, only within the period of prize awards. To collect the prize, the customer is required to show the following documents:

A valid coupon with the same lucky draw code as the winning code announced by Vinpearl JSC.

ID/passport number matches with the information which has been submitted to the system of Vinpearl JSC

Valid messages/emails notifying on the prize winning from Vinpearl JSC

The last day of the prize awards period is 25/02/2019. After this period, all the prizes that are not collected will be handled following Clause 4 Article 96 of Commercial Law.

The customer has the responsibility to pay for any fees incurred when collecting the prize and irregular income tax.

The winning customer will be liable for all accommodation, traveling and transportation expenses (applied to the 1st prize), property ownership and registration fee.

The winning customer has to fulfill the extraordinary income tax (if any) according to the current legistration.

7. Responsibility of information announcement:

● Vinpearl JSC holds the responsibility of announcing the complete details of the terms and conditions of the Promotion Program, the value of each prize in the regions that hold the promotion programmes. The announcement should be made on at least one social media channel and on the website: vinperal.com (public media and social media – same thing?)

● Vinpearl JSC will publish the full list of winning customers on at least one public broadcasting channel and on the website: vinpearl.com

8. Others

● The organization of the Promotion Programme must ensure that the draw is truly random, objective and public.

● If winning, the customer consents that Vinpearl JSC will use their name and photos for marketing and promotion purposes

● In the event of complaints and disputes related to the Promotion Programme, Vinpearl JSC takes full responsibility for resolving the issue. If unresolved, disputes will be handled according to the current legistration of Vietnam.
